MANAGING EXTENSION OF TIME (EOT)

Managing Extension of Time (EOT) and Additional Cost Claims

At Efficore, we understand that large-scale renewable energy projects, including offshore and onshore wind developments, are inherently complex and subject to various unforeseen circumstances. To protect the interests of our clients and ensure the smooth progression of projects, we take a proactive, systematic approach to managing Extension of Time (EOT) claims and additional cost claims whether you’re a developer or a Contractor.

Extension of Time (EOT) Claims

Delays in construction projects are not uncommon, and when they occur, it’s critical to properly manage EOT claims. Efficore takes a meticulous approach to assess the reasons for delays, whether caused by external factors, such as adverse weather conditions, regulatory changes, site conditions or delays attributable to other parties or unforeseeable circumstances.

Our team works closely with project stakeholders to:

  1. Identify and assess the root cause of the delay: We examine the circumstances surrounding the delay, including contractual obligations and external conditions that might justify an extension.

  2. Ensure compliance with contract terms: Efficore's experts carefully review the contract to ensure that any EOT claim is valid and complies with the terms outlined in the agreement. We also ensure the proper documentation and evidence are provided to substantiate the claim.

  3. Drafting of compliant notices: ensuring notices adhere to the contract terms and are submitted within the contract timescales.

  4. Negotiate fair outcomes: We facilitate discussions between all relevant parties, including contractors, suppliers, and clients, to reach a fair, equitable solution while mitigating any impact on project delivery and performance.

  5. Optimise project timelines: In many cases, Efficore works with the project team to reschedule work, introduce efficiencies, or implement mitigation strategies to minimise the impact of the delay and avoid any further disruption to the overall project schedule.

  6. Common Law or other Jurisdictional Remedies:  We are able to advise on remedies outside of the Contract and in line with Common Law or or Civil Law principles which are fair and reasonable and provide further comfort to the Party we are representing

Additional Cost Claims

Similarly, additional cost claims can arise due to a variety of factors such as unforeseen site conditions, changes in the scope of work, or increases in material costs. At Efficore, we manage these claims with transparency and precision:

  1. Rigorous cost assessment: Our team conducts a thorough review of the original budget and identifies the specific areas where costs have escalated. This includes evaluating scope changes, variations in labour or material costs, or external factors like inflation or supply chain disruptions.

  2. Detailed documentation and justification: We ensure that all additional costs are clearly documented, justified, and aligned with the contractual terms. This includes providing clear, itemised breakdowns and evidence to support the claim, whether for additional labour, equipment, or materials.

  3. Effective negotiation with stakeholders: Our experience in contract management allows us to engage in informed and constructive discussions with contractors, suppliers, and clients to ensure any cost increases are both justified and reasonable. We aim to reach a fair settlement that aligns with the interests of all parties involved.

  4. Mitigation and cost control: Efficore is committed to minimising the impact of unforeseen costs on project budgets. We apply proven cost control measures, recommend alternatives where possible, and advise on strategies to minimise future claims by identifying and addressing potential risks early on.

By expertly handling EOT and additional cost claims, Efficore ensures that projects stay on track, with minimal disruption to project timelines and budgets. Our commitment to transparency, collaboration, and effective risk management allows us to navigate these challenges with confidence, helping clients achieve successful project outcomes even in the face of unforeseen hurdles.
